The purpose of Rivnet.com is to provide commercial grade computer connectivity to its Customers and Customer Support when needed. This Policy Statement represents a guide to the acceptable use of the Rivnet.com backbone by its Customers and to the expectations and requirements for the acceptable use of that backbone by the Customers. All policies stated herein are subject to change upon fifteen (15) days prior written notice.

Any violation of the Rivnet.com Acceptable Use Policies or other unacceptable use of the Rivnet.com backbone by the Customer, as determined in the sole and exclusive discretion of Rivnet.com, shall be subject to immediate termination or suspension of all Rivnet.com products and services.

1. All use must be consistent with the purposes of Rivnet.com as set forth in the first paragraph above. All use must be permitted by applicable local, state, and federal laws. The customer may not use Rivnet.com services to conduct any business or activity or solicit the performance of any activity that is prohibited by law.

2. All data traveling onto other network backbones via Rivnet.com consistent with the purposes and policies of those backbones.

3. All USENET traffic originating from or being received by Rivnet.com, unless explicitly allowed by the charter of a newsgroup or mailing list, must, at a minimum, conform to, but is not limited to, the following:

(a) Commercial (for profit) advertising is strictly forbidden in all groups except those groups whose charter specifically allows for commercial advertising.

(b) Spamming (Mass posting of messages) is strictly forbidden. Filters, site-wide killfiles, and all other means and devices used to counter Spamming will be used without any notice or written consent of Customers.

(c) Using newsgroups to collect E-Mail addresses for mail-bombing or junk-mailing is strictly forbidden.

4. Junk mailing or bulk mailing of advertising or any other electronic information is expressly forbidden unless all recipients of the information have either requested the information or explicitly given permission to receive the messages.

5. All use must comply with accepted Net Etiquette.

6. Any use of Products and Services deemed, in the sole discretion of Rivnet.com, to be destructive, obstructive, or otherwise contrary to these Policies, including, but not limited to, any data or information that could interfere with standard bandwidth utilization or business practices of Rivnet.com, shall be subject to immediate termination of access and services. In the event of any termination of access or services, Rivnet.com shall not be responsible for the forwarding of any E-mail, preservation of data stored on the Rivnet.com systems, losses of connectivity or any other losses, direct or indirect, consequential, or otherwise associated therewith.

7. Any use of Rivnet.com resources that disrupts the normal use of the system for other Rivnet.com customers is considered, in the sole discretion of Rivnet.com, to be abuse of system resources and shall be subject to immediate termination of access and services. In the event of any termination of access or services, Rivnet.com shall not be responsible for the forwarding of any E-mail, preservation of data stored on the Rivnet.com systems, losses of connectivity or any other losses, direct or indirect, consequential, or otherwise associated therewith.

8. Rivnet.com reserves the right to monitor any and all use of the Rivnet.com system, including, but not limited to, WWW, HTTP, FTP, WAIS, GOPHER or any other widely available data residing in the Customer's private areas on the Rivnet.com computer systems.

9. The Customer shall not violate any copyright, patent, trademark or other proprietary rights in their use or posting of information to the Internet through the Rivnet.com backbone. The Customer shall be responsible for any and all such violations or infringements and shall hold Rivnet.com harmless therefrom.

10. Any and all use of the Rivnet.com System that is viewed by the greater USENET culture will be reviewed, and for any violation of the accepted Policies, the Customer will be instructed to cease all related actions and/or be subject to immediate termination as provided herein.

11. Unless otherwise agreed, the Customer's right to use the Rivnet.com service or to designate users is not transferable and is subject to any limits established by Rivnet.com.

12. Multiple members of the same household may share a single User ID Name. However, only one person is authorized to access the Rivnet.com service at any given time using the User ID Name. Additional E-mail addresses do not allow for multiple users to access the Rivnet.com service at the same time.

13. CUSTOMER EXPRESSLY AGREES THAT USE OF THE Rivnet.com SERVICE IS AT THE CUSTOMER'S SOLE RISK. NEITHER Rivnet.com, ITS EMPLOYEES, OFFICERS, DIRECTORS, AFFILIATES, AGENTS, THIRD PARTY INFORMATION PROVIDERS, MERCHANTS, LICENSORS OR THE LIKE, WARRANT THAT THE Rivnet.com SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE Rivnet.com SERVICE, OR AS TO THE ACCURACY , RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE Rivnet.com SERVICE. THE Rivnet.com SERVICE IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. Rivnet.com MAKES NO WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED WITH RESPECT TO THE SOFTWARE PROVIDED. IN NO EVENT SHALL Rivnet.com BE LIABLE TO YOU OR ANY THIRD PARTY FOR CONSEQUENTIAL, SPECIAL, INDIRECT OR INCIDENTAL DAMAGES WHICH MIGHT RESULT FROM USING THE SHAREWARE SOFTWARE, INCLUDING, BUT NOT LIMITED TO, LOSS OF INFORMATION OR MATERIAL OF ANY KIND.

THE CUSTOMER UNDERSTANDS THAT ENROLLMENT AND USE OF THE Rivnet.com SERVICE CONSTITUTES AN AGREEMENT TO BE LEGALLY BOUND AND TO ABIDE BY THE TERMS OF THE Rivnet.com ACCEPTABLE USE POLICY.
