Inside Wire Maintenance Agreement (IWMA)
Riviera Telephone Company,
Inc. (RTC) shall, upon the customer’s acceptance, provide maintenance and
repair on the customer’s inside wiring (IW) and connector block at the monthly
charge as indicated in this agreement.
DEFINITIONS
IW – the
wire on the customer’s premise that extends from the protector to the connector
block or demarcation point
Protector
- the point
where the cable from underground connects to the IW
Connector
Block – commonly known as a “jack”, connects the IW to the telephone set
Demarcation Point – a
block where the IWs terminate at business locations or large residential
locations where many long run IWs are home run
Detached Extension – an extension located
outside of the primary customer premise
Leased Telephone Set – a
telephone set that the customer is leasing from RTC
Complex Wiring – wiring
that is, by its nature, more complex than normal business system and key system
wiring, looped wiring, wiring in large structures that entail long runs of IW
to wire
SERVICES
This IWMA shall include all
labor and materials necessary to maintain or repair the IW and/or connector
block using RTC installation practices and technical standards. Only one IWMA and monthly charge shall apply
to a customer’s premise, regardless of the number of connector blocks or
telephone sets on the customer’s primary premise, except for a detached
extension. A detached extension will
require another IWMA and an additional monthly charge. RTC will provide service to the telephone set
ONLY if the telephone set is an RTC leased telephone set.
TERM
The customer must agree to
keep the IWMA for at least one (1) year, provided the customer has service at
the named location for that period of time. The customer may terminate the
agreement at any time after the original one year term. If the IWMA is not terminated it shall renew
automatically on a monthly basis. Should
the customer discontinue service at the location, this IWMA shall terminate
automatically. The customer may initiate
a new IWMA at a new location if the new location’s IW meets RTC installation
practices and technical standards. The
customer shall have the right to terminate this IWMA within sixty (60) days
after being notified of an increase in the charges of the IWMA, regardless of
the original term of the IWMA.
EXCLUSIONS
This IWMA does NOT include and
shall exclude repair or maintenance of IW or connector block that includes, but
is not limited to:
1.
vandalism
2.
willful damage
3.
gross negligence
4.
complex wiring
5.
damage due to acts
of God or war
6.
customer requests
for new installation of IW to a new location
7.
customer requests
for installations to move or change the telephone set
8.
wiring or
connector blocks that do not meet RTC installation practices or technical
standards
This IWMA also does NOT
include and shall exclude:
1.
line cords
2.
telephone sets
3.
business systems
not installed by RTC
4.
telephone sets of
a business system
CHARGES
The IWMA shall be billed to
the customer on a monthly basis in advance on the customer’s bill. Should the customer disconnect service from
RTC, the customer shall receive credit for the prorated charges for this IWMA
on the final bill. The monthly charge
for this IWMA shall be as follows:

The charges stated may be
changed by RTC at any time. RTC shall
provide the customer thirty (30) days advance notice of any change in the rates
for the IWMA. This notice shall be
limited to a statement included in the customer’s monthly telephone bill. No other notice shall be given or
required.
ACCEPTANCE
I, the customer, have read
this agreement and understand the terms and conditions of this IWMA. I authorize RTC to bill the charges, as may
apply to this agreement on my monthly bill and to perform the service as
provided in this agreement.
